When a family calls me
Usually it is sudden. Someone is admitted, a procedure is scheduled, and a power of attorney or advance health care directive needs to be in place before it happens. Those calls do not fit business hours, and I take them seriously.
What I need from you is the document, finished, and a realistic read on whether the patient can understand what they are signing. Everything else I can work around.
The one thing that stops a bedside signing
Capacity. A notary cannot notarize for someone who is unconscious, heavily sedated, or unable to understand what they are signing. No matter how urgent it is, no matter who asks, and no matter what the family agrees on.
I will make the trip and assess it in person, and I will tell you honestly at the bedside. If the answer is no, I will explain what your alternatives are so you are not left guessing. That conversation is worth having early rather than at 9pm the night before surgery.
Documents most often signed at a bedside
- Advance health care directive
- Durable power of attorney for finances
- Health care power of attorney
- Living trust and trust amendments
- Grant deed transferring property into a trust
- Affidavits and beneficiary designations
How to make it go quickly
- Have the document completely filled out before I arrive
- Have the patient's photo ID at the bedside. An expired license is a problem
- Check whether the document needs witnesses, and line them up (hospital staff often cannot serve)
- Let the nursing staff know a notary is coming and when
- Pick a window when the patient is most alert. Usually mornings

Hospital Signings. Common questions
Can you notarize for a patient who is sedated?
No. The signer must be alert, aware of what they are signing, and signing willingly. If a patient is sedated, confused, or unable to communicate, I am legally required to decline. I will tell you that in person rather than take the fee and leave you with an invalid document.
The patient can't sign because of a physical condition. Any options?
California has a signature-by-mark procedure and, separately, a signature-by-proxy procedure, both of which require additional witnesses and specific handling. Tell me the situation when you call so I bring the right paperwork and we get the witnesses arranged.
What ID does the patient need?
A current government-issued photo ID. If the ID is expired or missing, California allows identification by two credible witnesses who personally know the signer, under specific conditions. Mention this when you call so we can set it up rather than discovering it at the bedside.
How fast can you get there?
Depending on the day and the facility, often the same day. Call rather than fill out the form if it is genuinely urgent.
Do you go to hospice and nursing homes?
Yes. Hospice, skilled nursing, assisted living, and memory care throughout Orange County and nearby Los Angeles County.
