Affidavit of Inability to Appear — Inmate & Hospital Marriages
When one person cannot physically get to the County Clerk to apply for a marriage licence, California lets them sign an Affidavit of Inability to Appear instead. That signature has to be authenticated by a notary public before the clerk will issue the licence. That is the piece I handle, including inside Theo Lacy and select correctional facilities.

The problem the affidavit solves
California normally requires both applicants to appear at the County Clerk's office to apply for a marriage licence. If one of them is in custody, that is impossible. The Affidavit of Inability to Appear is the county's answer: the person who cannot appear signs it instead, and their signature is authenticated by a notary public or a court before the clerk will issue the licence.
County clerk forms cite Family Code sections 426 and 502, covering public and confidential marriage licences. Both parties and the person solemnizing the marriage sign the affidavit.
Process
How it goes, in order
Confirm what your county needs
For an incarcerated party, counties generally want the Affidavit of Inability to Appear plus a Verification of Incarceration and a Certificate of Intention. Requirements differ between counties and between facilities, so check with the issuing County Clerk first.
Complete the affidavit before the visit
Every blank filled in except the signatures. I cannot prepare it, complete it, or advise you on what it should say. That is the clerk's form and your officiant's or attorney's territory.
I notarize the signature inside the facility
Scheduled through the facility's own procedures. The person signing needs valid identification on file and must be aware and willing, the same standard as any notarization.
The clerk issues the licence
Once the authenticated affidavit is submitted with the rest of the paperwork, the licence is issued to the person solemnizing the marriage, who performs the ceremony at the facility subject to its rules.

FAQ
Inmate marriage questions
What is an Affidavit of Inability to Appear?
It is the county form used when a marriage licence applicant physically cannot come to the County Clerk's office, usually because they are incarcerated or hospitalized. Both parties and the person solemnizing the marriage sign it, and the signature of whoever cannot appear has to be authenticated by a notary public or a court before the clerk will issue the licence. Counties cite Family Code sections 426 and 502.
Can you notarize the affidavit and also perform the wedding?
No, and this matters. County clerks state that the notary who authenticates the signatures cannot also be the person solemnizing the marriage, citing Government Code 8224(a). I will do one or the other for your marriage, never both, and I will tell you which before you book.
Which facilities do you visit for this?
Theo Lacy and select correctional facilities in Orange County, plus hospitals and care facilities for the same affidavit when someone is too unwell to appear. Scheduling follows each facility's own procedures rather than mine.
What else does the county need for an incarcerated party?
Commonly a Verification of Incarceration and a Certificate of Intention alongside the affidavit, plus valid government-issued photo identification for both applicants. Confirm the exact list with the County Clerk issuing your licence, because it varies.
How does payment work?
Prepayment is required and payment is non-refundable, the same as every correctional facility visit. The trip to the facility is made whether or not the signing can be completed, and that is outside anyone's control.
Do you do hospital cases too?
Yes. The same affidavit is used when someone is hospitalized and cannot appear, and counties typically also want proof of hospitalization on letterhead. Capacity rules apply: the person signing must be alert and able to understand what they are signing.
